If stem cell-based therapies are developed, we will likely confront a difficult problem of justice: for biological reasons alone, the new therapies might benefit only a limited range of patients. In fact, they might benefit primarily white Americans, thereby exacerbating long-standing differences in health and health care.

John Rawls’s political liberalism and its ideal of public reason are tremendously influential in contemporary political philosophy and in constitutional law as well. Many, perhaps even most, liberals are Rawlsians of one stripe or another. This is problematic, because most liberals also support the redefinition of civil marriage to include same-sex unions, and as I show, Rawls’s political liberalism actually prohibits same- sex marriage. Recently in Perry v. Schwarzenegger, however, California’s northern federal district court reinterpreted the traditional rational basis review (...) in terms of liberal neutrality akin to Rawls’s “public reason,” and overturned Proposition 8 and established same-sex marriage. (This reinterpretation was amplified in the 9th Circuit Court’s decision upholding the district court on appeal in Perry v. Brown.) But on its own grounds Perry should have drawn the opposite conclusion. This is because all the available arguments for recognizing same-sex unions as civil marriages stem from controversial comprehensive doctrines about the good, and this violates the ideal of public reason; yet there remains a publicly reasonable argument for traditional marriage, which I sketch here. In the course of my argument I develop Rawls’s politically liberal account of the family by drawing upon work by J. David Velleman and H. L. A. Hart, and discuss the implications of this account for political theory and constitutional law. (shrink)

Niche construction is the process whereby organisms, through their activities and choices, modify their own and each other’s niches. By transforming natural-selection pressures, niche construction generates feedback in evolution at various different levels. Niche-constructing species play important ecological roles by creating habitats and resources used by other species and thereby affecting the flow of energy and matter through ecosystems—a process often referred to as “ecosystem engineering.” An important emphasis of niche construction theory (NCT) is that acquired characters play an evolutionary (...) role through transforming selective environments. This is particularly relevant to human evolution, where our species has engaged in extensive environmental modification through cultural practices. Humans can construct developmental environments that feed back to affect how individuals learn and develop and the diseases to which they are exposed. Here we provide an introduction to NCT and illustrate some of its more important implications for the human sciences. (shrink)

Doctors have an ethical and legal duty to respect patient confidentiality. We consider the basis for this duty, looking particularly at the meaning and value of autonomy in health care. Enabling patients to decide how information about them is disclosed is an important element in autonomy and helps patients engage as active partners in their care.Good quality data is, however, essential for research, education, public health monitoring, and for many other activities essential to provision of health care. We discuss whether (...) it is necessary to choose between individual rights and the wider public interest and conclude that this should only rarely be necessary. The paper makes some recommendations on practical steps which could help ensure that good quality information is available for work which benefits society and the public health, while still enabling patients’ autonomy to be respected. While new generations of implantable brain computer interface devices are being developed, evidence in the literature about their impact on the patient experience is lagging. In this article, we address this knowledge gap by analysing data from the first-in-human clinical trial to study patients with implanted BCI advisory devices. We explored perceptions of self-change across six patients who volunteered to be implanted with artificially intelligent BCI devices. We used qualitative methodological tools grounded in phenomenology to conduct in-depth, semi-structured interviews. Results (...) show that, on the one hand, BCIs can positively increase a sense of the self and control; on the other hand, they can induce radical distress, feelings of loss of control, and a rupture of patient identity. We conclude by offering suggestions for the proactive creation of preparedness protocols specific to intelligent—predictive and advisory—BCI technologies essential to prevent potential iatrogenic harms. Archaeologists have proposed that behavioral knowledge of a tool can be conceptualized as a “recipe”—a unit of cultural transmission that combines the preparation of raw materials, construction, and use of the tool, and contingency plans for repair and maintenance. This parallels theories in cognitive psychology that behavioral knowledge is hierarchically structured—sequences of actions are divided into higher level, partially independent subunits. Here we use an agent-based simulation model to explore the costs and benefits of hierarchical learning relative to holistic learning, (...) where entire behavioral sequences are learned in an all-or-nothing fashion, and diffusionist learning, where actions are completely independent. Hierarchical learning is favored under the reasonable assumptions that learning is associated with some degree of both error and cost, and that behavior can be grouped into subunits that repeat in one or more tool recipes. These general predictions can be tested in the archaeological and ethnographic record. Recent advances in evolutionary developmental biology have revealed a number of parallels between the hierarchically structured, recipe-like organization of behavioral knowledge that we examine here and the manner in which biological organisms develop. In the online age, however, social phenomena can occur with unprecedented scale and unpredictability, and individuals have access to social connections never before possible. Similarly, behavioral scientists now have access to “big data” sets – those from Twitter and Facebook, for example – that did not exist a few years ago. Studies of human (...) dynamics based on these data sets are novel and exciting but, if not placed in context, can foster the misconception that mass-scale online behavior is all we need to understand, for example, how humans make decisions. To overcome that misconception, we draw on the field of discrete-choice theory to create a multiscale comparative “map” that, like a principal-components representation, captures the essence of decision making along two axes: aneast–westdimension that represents the degree to which an agent makes a decision independently versus one that is socially influenced, and anorth–south dimensionthat represents the degree to which there is transparency in the payoffs and risks associated with the decisions agents make. We divide the map into quadrants, each of which features a signature behavioral pattern. When taken together, the map and its signatures provide an easily understood empirical framework for evaluating how modern collective behavior may be changing in the digital age, including whether behavior is becoming more individualistic, as people seek out exactly what they want, or more social, as people become more inextricably linked, even “herdlike,” in their decision making. We propose using a bi-axial map as a heuristic for categorizing different dynamics involved in the relationship between quality and popularity. The east–west axis represents the degree to which an agent’s decision is influenced by those of other agents. This ranges from the extreme western edge, where an agent learns individually (no outside influence), to the extreme eastern edge, where an agent is influenced by a large number of other agents. The vertical axis represents how easy or difficult it is (...) for an agent to discern the relative quality of available choices. When a case study is located on the map, it becomes easier to select the range of tools to use for understanding and predicting the relation between quality and popularity. (shrink)

The “New Natural Law” Theory (NNL) of Germain Grisez, John Finnis, Joseph Boyle, and their collaborators offers a distinctive account of intentional action, which underlies a moral theory that aims to justify many aspects of traditional morality and Catholic doctrine. -/- In fact, we show that the NNL is committed to premises that entail the permissibility of many actions that are irreconcilable with traditional morality and Catholic doctrine, such as elective abortions. These consequences follow principally from two aspects of the (...) NNL. The first aspect is its distinctive version of the planning theory of intention, in which adopting the 'first-person perspective' of an agent is a sufficient, and not merely necessary, condition for determining the nature of his intentional action; this planning theory rests upon an implicitly Cartesian conception of human behavior, in which behavior chosen by an agent has no intrinsic “intentionalness” apart from what he confers upon it as part of his plan. The second aspect is the NNL's distinctive account of basic human goods' incommensurability, according to which there is no common factor shared by basic human goods that allows them to be comparatively ranked in any way that directs practical deliberation. -/- The entailments of these two aspects of the NNL, we argue, amount to a reductio ad absurdum. Pace the proponents of the NNL account, we sketch an alternative hylomorphic conception of intentional action that avoids untoward moral implications by grounding human agency in the exercise of basic powers that are either (a) essential constituents of human nature or (b) acquired through participation in social practices. In Intention and her subsequent essays that addressed human action, Elizabeth Anscombe made signal contributions to the Aristotelian-Thomistic tradition, and to western philosophy more broadly. The new natural law theory of Germain Grisez, John Finnis, Joseph Boyle, and their collaborators mistakenly claims to be consonant with Anscombe’s work. A central reason for this misappropriation lies in the failure to understand the ways in which Anscombe does and does not deploy a “first-person perspective” in analyzing intentional action. Many environmentalists believe that the ethos of capitalism is a primary cause of environmental degradation, arguing that only a fundamental shift away from the materialism and competition of the marketplace will allow humans to live within the earth's carrying capacity. A different strand of contemporary thought, free market environmentalism, argues the opposite: private ownership, individual choice, and the creative forces of human ingenuity are the best available means to solve ecological problems. This essay considers how Christian ecological ethics should respond (...) to free market environmentalism, identifying its moral claims and the theoretical questions it poses to our field while also critiquing the shortcomings that accompany its economic view of human nature and character. This article explores ways pre-service teachers learn to work upon their positive emotional conduct during an initial teacher education course. The article argues that education practice today promotes the acting out of positive emotions, creating conditions within which pre-service teachers ethically shape their emotional conduct. Utilising Foucault’s four-part ethical framework, the article draws on longitudinal research of pre-service teachers in Western Australia to analyse the crafting of emotional conduct through techniques of the self. The techniques the participants came to employ (...) during their course learning aligned with a telos of the resourceful, positive, and professional teacher. The article argues that this ethical enterprise relies on a certain model of teacher subjectivity which is inseparably linked with normalising governmental power. Such disciplining of emotions, however, is neither one-dimensional nor deterministic; rather, work at the intersection of the government of others and of oneself. We argue this allows pre-service teachers the freedom to care for the self as they seek to foster their own ethical practices as teachers. (shrink)

Given the numerous parallels between the archaeological and paleontological records, it is not surprising to find a considerable fit between macroevolutionary approaches and methods used in biology – for example, cladistics and clade-diversity measures – and some of those that have long been used in archaeology – for example, seriation. Key, however, is recognizing that this methodological congruence is illusory in terms of how evolution has traditionally been viewed in biology and archaeology. (Published Online November 9 2006).

Substantial medical evidence shows that about half of ovarian cancers originate in the fallopian tube. Some medical organizations and clinical articles have suggested opportunistic salpingectomy to reduce the risk of ovarian cancer in patients at average risk of developing it. This entails removing the fallopian tubes at the same time as another procedure that would occur anyway. The authors argue that the principles of totality and double effect can justify such salpingectomies, even though there is a low incidence of ovarian (...) cancer. Since screening tools for ovarian cancer are ineffective and treatment options are poor, the good effect of reducing the risk of death from this type of ovarian cancer can be proportionate to the bad effects of the minor increase in surgical risk over the other procedure, the unintended side effect of infertility, and the removal of normally functioning tissue. The authors conclude that it is within the purview of a patient and physician to determine whether the benefits are proportionate to the risks in a particular case. (shrink)

The project of the paper is a critical examination of the "strong thesis of eliminative materialism" in the philosophy of mind--The claim that all the mental entities that constitute the framework of commonsense psychology are, In principle at least, Eliminable from our ontology. The central conclusion reached is that the traditional formulation of this thesis is demonstrably untenable as it rests on a mistaken view of the relationship between our psychological self-Knowledge and language.

The plot of Iphigenia in Tauris is usually thought to be Euripides' own invention. Its basic assumption can be found in Proclus' summary of the Cypria, viz. that a deer was substituted for Iphigenia during the sacrifice at Aulis and that she herself was removed to the land of the Tauri. Her later rescue by Orestes and Pylades, however, cannot be traced with probability to any work of art or literature earlier than Euripides' play. In this play, in which Orestes (...) recognizes and then saves the sister whom he had long thought dead, it is assumed that her replacement by a deer went unseen by those present at the sacrifice. The sequel which this assumption allowed Euripides to invent is original only in a limited sense, since it bears the imprint of several familiar story types. These types include the following: the murder of a kinsman is narrowly averted by a recognition; a reunion is followed by an intrigue; and a maiden is rescued. Each is used elsewhere by Euripides. The first two, for example, are found in Cresphontes, the second in Electra, and the third in Andromeda. Correspondences of this sort, based on plot patterns, will naturally gain in interest if it can be shown that they throw light on a play's meaning or on the process that led to its creation. The student of dramatic plots, however, soon discovers that analogies between them are easy to draw and can be quickly multiplied. (shrink)

The ‘no-suicide contract’ is a frequently utilized tool in both the assessment and dispersal of suicidal patients. However, little attention has been given to questioning whether suicidal persons are able to give informed consent to enter such a contract. This article utilizes both the existing literature on no-suicide contracts and the results of recent research into the effects of this tool, to examine whether its use is consistent with the legal and ethical doctrine of informed consent. Particular attention is given (...) to issues of competence, fullness of information, voluntariness and paternalistic intervention when no-suicide contracts are used. This analysis finds the tool to be problematic and suggests that individual patients’ ability to give informed consent about a no-suicide contract needs to be carefully considered by clinicians. Each book advances Christian environmental ethics in important ways; considered together, they have much to teach about the content and methods of the field.Northcott’s A Political Theology of Climate Change argues that climate change is a “cosmopolitical crisis” and that Christians should embrace a more ecological and theological politics in response. Theologians and ethicists have long argued that environmental degradation has cosmological roots: The belief that human beings are separate from nature makes global-scale degradation and pollution acceptable. Northcott adds a nuanced political analysis, noting that modern politics is based on a denial “that the weather is political, or that politics influences the climate” (46). Enlightenment thinkers who laid the groundwork for contemporary political structures insisted that storms and floods were not divine responses to human behavior, so modern nation-states are premised on an ideological separation from nature. Climate change reveals the failure of such thinking, so the facts of climate change pose an inherently political challenge.Thus, failures to act on climate change are political failures. Mainstream politics cannot consider that economic growth is unsustainable because it is premised on ignorance about nature. Nations cannot collaborate to solve the problem because they have no common moral agreement “about the ends and goals of human life” (245). We agree that the emergence of cumulative technological culture was tied to nonsocial cognitive skills, namely, technical-reasoning skills, which allowed humans to constantly acquire and improve information. Our concern is with a reading of the history of cumulative technological culture that is based largely on modern experiments in simulated settings and less on phenomena crucial to the long-term dynamics of cultural evolution.

White climate ethicists have a responsibility to learn, teach, and write about the intersections between climate change and white supremacy. Learning from Andrea Smith’s understanding of white supremacy as three pillars—commodification, orientalism, and genocide—built from heteropatriarchy, this essay argues that white climate ethicists should focus on particular experiences rather than universal narratives; learn from histories of colonization, slavery, and genocide; and support coalitions that empower people of color and indigenous communities.
